I. Object of the contract
On the ground of the present rental contract, the Renter hereinafter referred to as YRY Rent a Car gives to the Lessee, hereinafter referred to as Customer, the usage rights on the car and its endowments, described in the minute, annexed to the present contract.
II. Duration of the contract
The contract takes effect at the time of its signature and the signature of the minute. A minimum rental period of 24 hours is required for all rentals, starting from the date and time established in the contract until the next day same hour, with a 120-minutes grace period. After such time, a full-day fee will be charged according to the contract, YRY Rent a Car having the right to retain the owed money from the guarantee. Overtiming the drop time with 4 hours needs YRY Rent a Car approval, otherwise, YRY Rent a Car reserve the right to inform and declare the same car stolen, recovering the rented car on the Customer’s expense.
III. Car reservation / availability
Reservations will be made on line, by telephone/fax, is free and may be canceled with at least 24 hours before dropping it off. The reservation of the car is considered sure only when it is confirmed by YRY Rent a Car. The reservation will be confirmed for a car category and not for a car. In case YRY Rent a Car, at the time of picking-up, does not have available a car from the category for which the reservation has been confirmed, YRY Rent a Car will offer to the Customer a car from a superior category, but for the initial price, so the price charged to the Customer will be the same. The cars are available in Timisoara and in other towns upon request. When you make a reservation please make sure that you have filled down correctly the exact address where you want us to deliver the car (e.g. Timisoara airport, or the hotel where you leave, etc.). Delivering the car to the address specified by you is free of charge in Timisoara, at its borders.
Pick-ups and Drop-offs
No charge pick-ups and drop-offs in Timisoara and to Timisoara Airport. You will receive the car with a certain level of fuel in the tank. When dropping off the car, the tank should have the same level of fuel. If the vehicle is returned with less fuel than the initial quantity, you should pay the difference at the price from Peco gas stations. The mileage included in the rental fee is 350 km / day. In case off over passing this limit, the supplementary kilometers will be charged with 0.10 eurocents/km. As far as corporate contracts are concerned, the number of km/day are negotiable.
V. Rental Rates and Payment Methods
YRY Rent a Car accepts the following methods of payment:
- credit cards: Visa, Master Card, American Express, Euro Card

When paying with Visa and Master Card, it shall be applied a commission of 2% and with American Express a commission of 5 % from the total value of the invoice. The cash payments are accepted only together with a valid credit card, (for security reasons), except the corporate contracts. These shall be paid within 10 days from date of invoicing. For delays in paying the invoices in due time, the Customer shall pay 1% daily from the total amount of the invoice. Upon activation of the rental a security deposit in the amount of € 200-500 (depending on the vehicle class) shall be blocked on the renter’s credit card. The rental rate and the deposit are calculated on the ground of the price list and shall be paid when dropping-off the car. The guarantee paid when renting can not be, under any circumstances, to be used for prolonging the rental period. The oil, the car maintenance and the insurance are included in the rental rate. For longer rental periods, the Customer may negotiate the rental rate. The fuel is not included in the price.
The Customer agrees to pay by credit card for any additional charges upon return of the car, such as: damage value when the car has been damaged because of him, parching tickets, parking fines, traffic-related fines, etc. As far as the legal persons are concerned, the invoice shall be sent to the Customer’s registered office, the latter binding himself by signing the present Contract to pay it fully within 10 days from the invoincing date. For delays in paying the invoices in due time the Customer shall pay 1% daily from the total amount of the invoice. By signing the present Contact, the Customer is confirming that he has been informed concerning the authorized initial amount for debiting his card and accepts any additional payment according to this contract. In case the Customer looses or deteriorates the car documents or the car keys, he shall pay an additional fee of 100 Euros that shall be debited from his card.
VI. Liability of the Renter
YRY Rent a Car binds itself to place at Client’s disposal the car object of the present contract in good operating state and according to the legal technical norms. The oil and the car maintenance come within YRY Rent a Car responsibilities.
YRY Rent a Car declines any responsibility for accidents caused to third parties, as well as for breakdowns caused by the Customer during the rental period, even if the latter has provided false information regarding his identity, address and driving licence.
YRY Rent a Car is not held responsible in case the personal belongings of the Customer or of his companions are being lost, theft or damaged.
YRY Rent a Car binds to:
-deliver the rental object on the date and under the provisions stipulated in the present contract; on this occasion a minute shall be concluded.
-conclude CASCO insurance policy, according to the choice made by the Customer for theft and damages.
If a technical problem occurs YRY Rent a Car will replace the rented car with another one, as soon as possible (meaning that if there is a breakdown and you will get in touch with us, we will send immediately another similar car to change the broken one).
VII. Liability of the Customer
The Customer binds:
- to return the vehicle to the Agreed Return Location by Agreed Return Date/Time
- to declare additional drivers
- not to rent the vehicle
- not carry more people than the number of places indicated in the coupon
- not to use the car for car racings, off road or hunting purposes
- to ensure that the Vehicle is used according to the manufacturer’s instructions and recommendations
- not carry people or property for reward
- not carry products, valuable papers or money without valid accompanying documents.
- in case of damage (scratch, burning, upholstery tearing, bent wheel rims, stroked shield) whose value is less than 200 Euros due to Customer’s fault, the Customer has to pay fully the damage when dropping off the car or this damage shall be debited from the guarantee value deposited when picking up the car
- the driver should have at least 21 years old and a 1 year old driving license
- to use the rented car according to its destination derived from the contract
- to keep the car’s integrity, not to wear or deteriorate it and to pay the cost for any loss of or damage to the Vehicle during the rental (burned, spotted or cut upholstery, or damages due to unsuitable usage of the car – bent and cracked wheel rims, stroked shield, etc.)
- to return the Vehicle to the Agreed Return Location by Agreed Return Date/Time in the same operation state, apart from fair wear and tear
- to pay the rental rate according to the terms and conditions stipulated in the contract
- not do or allow any work on the Vehicle object of the contract
- in case of accident caused by the driver being under the influence of alcohol and/or drugs, the responsibility for paying all the damages rests upon the Customer
- not allow the Vehicle to be operated or used by any person who has not been authorized when elaborating the contract
- not use the Vehicle for racing, pacemaking or any other sort of competition in order to check the vehicle’s performance
- make sure that the Vehicle is locked and secured (windows and doors are locked the alarms is activated each time the vehicle is parked
- to return the vehicle when the period of contract ends with same level of fuel in the tank as when it has been picked-up
- not carry passengers or goods for reward
- not do or allow any work on the Vehicle without YRY Rent a Car permission. Such repairs may only be done by a suitably authorized service center. Repairs that cost more than 20 Euros need YRY Rent a Car approval
- not cross the border with the Vehicle without the written consent of YRY Rent a Car
- not sell or rent or dispose of the Vehicle in any way
- may not use the rented car for school purposes or as school car
No matter if the insurance, as described below, has or not been accepted, the Customer is liable for the entire value of the repairs in case the vehicle has been damaged or in case of damage in any of the here above situations. Please note that in the unfortunate event of an accident, the Customer is bound to inform YRY Rent a Car and the nearest police station and an accident report obtained until the end of the rental period. Without this report the Customer could be responsible for the costs of repair. The insurances are applicable only if the Customer provides all the reports issued by the Police; otherwise, he is the only one held responsible for covering the repairs and is accepting to make this payment from the guarantee deposited when signing the present contract. If the amount into question does not cover the repair costs, the Customer authorizes YRY Rent a Car to take the necessary steps in order to obtain the amount into question. The Customer binds to keep for 90 days since the end of the rental period all the documents concerning the rental and to any other incidents produced in connection with YRY Rent a Car.
VIII. Insurance Policies
The Standard Insurance-CDW, included in the rental rate includes Basic Obligatory Insurance for YRY Rent a Car vehicles, in conformity with the provisions of the Romanian legislation, CASCO Insurance for damages and theft. The Customer’s liability is confine to the amount paid as guarantee and the payment for the damages caused due to his negligence, inside and outside the car (e.g. stroked wheel rims, burned upholstery, etc.). In case the value of the accident damages overpasses the limit established by the law, the Customer is directly liable for the difference between the total value of the damage and the maximum limit accepted by the law, agreeing to full coverage of the value and authorizing YRY Rent a Car to debit the card indicated for these values. The insured value does not include using the car for transporting inflammable substances.
The Customer may choose Full Insurance Super CDW (accident and theft). The Customer has to pay, within the limits covered by the security deposit, in case of theft, or if the inside of the car, the upholstery, etc. is damaged, its value being between 6-9 Euros/rental day, depending on the vehicle class. As well, the client can choose the PAI insurance for persons and the luggage (insurance for natural persons) at a price of EUR 3 / day. No matter the insurance type chosen by the Customer, he has to respect the provisions of chapter VII Liability of the Customer.
IX. Accident, damage or theft
In case of accident or theft the Customer has the following obligations:
- to inform immediately the Police about any accident, fire, theft or theft attempt, no matter the value of the damage;
- to inform YRY Rent a Car as soon as possible about any accident, fire, theft or theft attempt, even if the damage is partial and no matter its value;
- to get the documents that establish the damage, accident etc. from the Police Office, together with the alcoholometry results;
- to get the annex 2 from the Police – for the insurance company;
- to get the name and address of any eye witness;
- not to abandon the car.
X. Contractual liability
In the event that the contract is fundamentally breached by non-fulfillment or unsuitable fulfillment of the contractual obligations, either party should bear penalties. The force majeure exonerates the affected side from the fulfillment of his obligation according to the law. Force Majeure means facts or circumstances beyond the party’s control, which cannot be forethought and even if they could be, they cannot be prevented, which occurred after the conclusion of this contract, but they prevent or delay completely or partially the fulfillment of the contractual obligations. The party for whom it became impossible to meet his obligations under this Contract shall make every effort to eliminate as much as possible the consequences caused by Force Majeure.
XI. Causes for cancelling the rental contract
If the Customer fails to fulfill one of his obligations under this contract, YRY Rent a Car has the right to cancel the contract one-sided without refunding the costs for rental, insurance price, guarantee and any other taxes paid by the Customer for the vehicle object of this contract. In case the Customer wishes to cancel the contract before the due date, he is bound to pay the rent for the rest of the period remained.
XII. Arbitration
Any disputes which might arise out of this contract, including those referring to validity, interpretation, execution or termination, shall be settled amicably. Should the dispute fail to be settled amicably, all disputes shall be submitted to arbitration to the competent courts from Timisoara.
XIII. Other clauses
The contracting parties acknowledge that this contract together with the annexes constitute a sole document that proves the rights and obligations of both parties. Any amendment to the provisions stipulated in this contract shall be valid only with the written consent of both parties, elaborating ad Additional Act. The supplements / modifications made to this contract are valid and opposable only if derives expressly from the documents signed by both contracting parties.
